These Terms of Service ("Terms") govern your use of BeachFit, operated by BeachFit LLC, a Connecticut limited liability company. By using BeachFit, you agree to these Terms. If you do not agree, please do not use the platform.

1. What BeachFit Is

BeachFit is a free platform that connects people through outdoor activities in their local communities. Users can discover, create, join, and host events such as pickup sports, trail hikes, beach yoga, and family activities.

BeachFit is not a fitness instruction service, a personal training platform, or a professional event management company. We provide the tools for community members to connect. The activities themselves are organized and run by community members, not by BeachFit LLC.

2. Your Account

To access most features, you must create an account via OAuth sign-in. By creating an account, you agree to:

• ·Provide accurate and truthful information about yourself.
• ·Keep your account credentials secure and not share access with others.
• ·Be at least 13 years of age (or have parental consent if between 13 and 18).
• ·Use one account per person. Multiple accounts for the same individual are not permitted.
• ·Notify us promptly at [email protected] if you believe your account has been compromised.

3. Community Standards

BeachFit is built on trust and respect. All users are expected to treat others with dignity. The following are not permitted on the platform:

• ·Harassment, bullying, threats, or abusive behavior toward any user.
• ·Discriminatory conduct based on race, gender, religion, national origin, disability, sexual orientation, or any other protected characteristic.
• ·Creating fake events, false profiles, or misleading activity listings.
• ·Using BeachFit to solicit money, sell products, or promote commercial services without prior written consent from BeachFit LLC.
• ·Collecting or harvesting other users' personal information without their consent.
• ·Posting spam, malware, or any content that disrupts the platform.
• ·Impersonating another person or entity.

Violations may result in account suspension or permanent removal from the platform.

4. Hosting Activities

When you create and host an activity on BeachFit, you take on responsibility for that event. As a host, you agree to:

• ·Provide accurate information about the activity, including location, time, and what participants should expect.
• ·Ensure the activity takes place in a public space where it is legally permitted.
• ·Treat all participants with respect and uphold BeachFit's community standards.
• ·Notify participants promptly if an event is cancelled or significantly changed.
• ·Not charge participants fees without prior written approval from BeachFit LLC.

5. Assumption of Risk

Outdoor physical activities carry inherent risks, including but not limited to physical injury, illness, property damage, and other hazards. By participating in any activity found through BeachFit, you voluntarily assume all such risks.

You are responsible for assessing your own fitness and health before participating in any activity. BeachFit LLC is not responsible for injuries, accidents, or incidents that occur during activities organized through the platform.

6. Limitation of Liability

To the fullest extent permitted by law, BeachFit LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform or participation in any activity.

BeachFit LLC's total liability to you for any claim arising from these Terms or your use of the platform shall not exceed the greater of $100 or the amount you paid to BeachFit in the 12 months preceding the claim (which, since BeachFit is free, is $0).

7. Intellectual Property

The BeachFit name, logo, and platform design are owned by BeachFit LLC. You may not use them without written permission.

Content you post on BeachFit (such as activity descriptions and photos) remains yours. By posting it, you grant BeachFit LLC a non-exclusive, royalty-free license to display and distribute that content as part of operating the platform.

8. Privacy

Your use of BeachFit is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We collect only what we need to operate the platform and never sell your data.

9. Termination

You may delete your account at any time by contacting us at [email protected].

BeachFit LLC reserves the right to suspend or terminate any account that violates these Terms, with or without notice. We will make reasonable efforts to notify you unless doing so would compromise platform safety or violate applicable law.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For significant changes, we will notify users via email or a notice on the platform. Continued use of BeachFit after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the State of Connecticut, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Connecticut.

13. SMS Communications and Phone Verification

BeachFit uses SMS text messages exclusively to send one-time verification codes (OTPs) for identity verification purposes. By providing your mobile phone number and requesting a verification code, you expressly consent to receive up to three (3) SMS text messages per verification session from BeachFit LLC.

Purpose: SMS messages are sent only to verify your phone number as part of BeachFit's identity verification and community safety program. We do not send marketing messages, promotional texts, or recurring automated messages to your phone number.

Message and data rates may apply. Standard carrier message and data rates may apply depending on your mobile plan. BeachFit LLC does not charge any fee for SMS messages.

Opt-out: You may opt out of SMS communications at any time by replying STOP to any message you receive from us, or by contacting us at [email protected]. After opting out, you will no longer receive SMS messages from BeachFit. Note that opting out of SMS may prevent you from completing phone verification, which is required for certain platform features such as hosting family-friendly events.

Help: For assistance, reply HELP to any message you receive from us, or contact us at [email protected].

Carriers: BeachFit is not responsible for delayed or undelivered messages. Supported carriers include, but are not limited to, AT&T, T-Mobile, Verizon, Sprint, Boost Mobile, MetroPCS, and U.S. Cellular.

By providing your phone number and clicking "Send Code," you confirm that you are the account holder or have the account holder's permission to use the number, and you consent to receive the SMS verification code described above. Consent is not a condition of using any other BeachFit service.
